Terms of Service

These terms are an agreement between you and Mind Clutter ("Mind Clutter", "we", "us"), operated from Ontario, Canada, covering your use of the Mind Clutter app.

By using Mind Clutter you agree to these terms. If you do not agree, do not use the app.

1. Mind Clutter is not medical care

Read this one.

Mind Clutter is a personal organisation and journalling tool. It is not a medical device, not therapy, not counselling, and not a substitute for professional help. Nothing it shows you — including AI-generated reflections, summaries, mood observations, or answers to questions about your own writing — is medical, psychological, or clinical advice.

Its observations are generated by software and may be wrong.

Do not use Mind Clutter to make decisions about your health. If you are struggling with your mental health, speak to a qualified professional. If you are in crisis or may be at risk of harming yourself, contact your local emergency services or a crisis line immediately. In Canada, call or text 988.

2. Who can use it

You must be 18 or older. By using Mind Clutter you confirm you are.

3. Your account

You need an account to use Mind Clutter. Keep your sign-in secure; you are responsible for what happens under your account. Tell us promptly at support@getmindclutter.com if you think someone else has access.

You may delete your account at any time from Settings → Account.

4. Your recovery code

Backup and sync is a Premium feature, included in the free trial. If you turn it on, the app gives you a recovery code. Your backup is encrypted with a key derived from it, and that key never reaches us.

If you lose your recovery code, your backup cannot be decrypted — not by you, and not by us. We cannot reset it, recover it, or work around it. This is a deliberate design choice that keeps your writing private from us. Store it somewhere safe.

5. Free trial and subscriptions

Mind Clutter offers a free trial. When it ends, some features require a paid subscription. Basic capture and reading of what you have already written stay available.

What happens to your cloud backup when Premium ends. Backup and sync runs only while your trial or subscription is active. When it ends, syncing stops and the app deletes your encrypted backup from our servers a few days later — the delay gives a renewal or a store outage time to resolve before anything is removed. Everything on your phone stays exactly as it is, and CSV export remains free, so you can always take your data with you. If you subscribe again, the app offers to turn backup back on and issues a new recovery code.

We also delete any backup that has not been updated for 12 months.

Prices are in US dollars; your store converts to your local currency and may add tax.

Billing is handled entirely by Apple or Google, not by us.

  • Payment is charged to your Apple or Google account on confirmation.
  • Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends.
  • Your account is charged for renewal within 24 hours before the period ends.
  • Cancel any time in your Apple App Store or Google Play account settings. Cancelling stops future renewals; it does not refund the current period.
  • If a free trial is offered and you subscribe during it, any unused part of the trial is forfeited.

Refunds are handled by Apple and Google under their own policies. We cannot issue refunds for store purchases. Contact Apple or Google support.

6. Price changes

We may change prices. Existing subscribers keep their price until we give notice, and any increase requires your consent through your app store before it takes effect. If you do not consent, your subscription simply does not renew at the new price.

7. Your content is yours

Everything you write in Mind Clutter belongs to you. We claim no ownership.

You grant us only the narrow permission needed to run the app: to transmit and process what you explicitly ask us to process (for example, sorting a dump), and to store your encrypted backup if you enable it. We do not use your content to train AI models.

8. Acceptable use

Do not:

  • Use Mind Clutter for anything unlawful.
  • Attempt to break, overload, probe, or reverse engineer the service, or circumvent limits, quotas, or payment.
  • Use automated means to send requests at a volume beyond normal personal use.
  • Attempt to manipulate the AI features into producing content unrelated to your own writing, or to extract system instructions.
  • Resell or redistribute the service.

We apply rate limits and daily limits to AI features to keep costs sustainable. We may suspend accounts that abuse the service.

9. Availability

We aim to keep Mind Clutter working, but we do not promise uninterrupted availability. Features that need the internet will not work offline. AI features depend on a third-party provider and may be unavailable or degraded.

We may change or discontinue features. If we discontinue the service entirely, we will give reasonable notice and a way to export your data.

10. Disclaimer

To the fullest extent permitted by law, Mind Clutter is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that AI output is accurate, complete, or suitable for any purpose.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss of goodwill.

Our total liability to you for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) CAD $50.

Some jurisdictions do not allow these limits, in which case they apply only to the extent permitted. Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.

12. Data loss

Keep your own copies of anything you cannot afford to lose. We are not liable for loss of data, including where you lose your recovery code, where a device fails, or where you uninstall the app or clear its data.

13. Termination

You may stop using Mind Clutter and delete your account at any time.

We may suspend or terminate your access if you materially breach these terms — in particular section 8. Where practical we will give notice first.

14. Privacy

Our Privacy Policy explains what happens to your data and forms part of these terms.

15. If you installed from the Apple App Store

Apple requires these terms when an app ships its own agreement instead of Apple's standard one. They apply only to copies obtained through the App Store.

  • This agreement is with us, not Apple. Apple is not a party to it, and we alone are responsible for Mind Clutter and its contents.
  • Licence scope. You get a non-transferable licence to use Mind Clutter on any Apple-branded product you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
  • Support. We are solely responsible for support. Apple has no obligation to provide any maintenance or support for Mind Clutter.
  • Warranty. We are solely responsible for any warranty, express or implied. If Mind Clutter fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever.
  • Claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to Mind Clutter — including product liability, any failure to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
  • Intellectual property. If a third party claims Mind Clutter infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
  • Legal compliance. You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
  • Contact. Questions, complaints or claims: support@getmindclutter.com, Mind Clutter, Ontario, Canada.
  • Third-party terms. You must comply with any applicable third-party terms when using Mind Clutter.
  • Apple may enforce these terms. Apple and its subsidiaries are third-party beneficiaries of this section, and Apple has the right to enforce it against you as a third-party beneficiary.

16. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, and the courts of Ontario have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory laws in your country of residence.

17. Changes to these terms

We may update these terms. If a change is material we will notify you in the app before it takes effect. Continuing to use Mind Clutter after that means you accept the change.
